Intellectual Property

Laws are in place to exclude all others for varying lengths of time from using specific types of artistic or scientific creations of the mind or intellect such as brands and logos, inventions, designs, software, music, paintings, photographs and literary works.
This legal protection of intellectual property rights which in some cases automatically arises and in others must be applied for, encourages new technologies, artistic and written expressions and inventions without the fear that a competitor will steal the idea and/or take credit for it.   Protecting these rights helps companies and individuals to maximize the growth of their businesses and secure an important source of revenue.  It is therefore important that individuals and companies that are trading or considering trading identify and protect their intangible assets as a sound business practice.

I have worked with many corporate and individual owners, creators and licensed users to secure and protect their intellectual property rights and offer a general service in this area.

My services include the following:

  • Preparing, filing and registering Trade Marks, Service Marks and Patents in Jamaica and procuring renewals thereof
  • Conducting clearance searches and advising on the availability of marks and the class of good and/or service to which the mark will apply
  • Negotiating, drafting and advising on agreements relating to intellectual property including licenses and assignments
  • Preparing, filing and registering Copyrights and advising on the enforcement of these rights

MY WORK

  • I advised a local gaming company on its trademark portfolio and related intellectual property rights.
  • I advised a local singer contracted to one of the world’s largest recording labels on the registration of his stage name as a service mark in Jamaica.
